Compliance & Regulatory
Sacred Alto Spores operates exclusively under the New Mexico Psilocybin Services Act (7.35.2 NMAC). This page outlines the statutory framework, our permitted producer obligations, transfer documentation standards, and chain-of-custody requirements governing all supply relationships.
New Mexico Psilocybin Services Act
The statutory and regulatory foundation governing all psilocybin cultivation, processing, and transfer activity in New Mexico under 7.35.2 NMAC.
Enabling Legislation
The New Mexico Psilocybin Services Act establishes the legal framework for a regulated therapeutic psilocybin services industry in New Mexico. The Act authorizes the permitting of producers, service centers, healing centers, and certified facilitators operating within the state's therapeutic psilocybin ecosystem under 7.35.2 NMAC.
Permitted Producer Classification
Sacred Alto Spores holds a state-issued Permitted Producer designation under 7.35.2 NMAC, authorizing the cultivation, processing, and transfer of psilocybin products exclusively to permitted service entities. Producer permits are issued and renewed by the New Mexico Department of Health.
Permitted Recipient Entities
Under the Act, psilocybin products may only be transferred to state-permitted healing centers, service centers, and certified clinical facilitators. Sacred Alto Spores does not transfer products to unpermitted individuals or entities under any circumstances. All recipient permits are verified before any order is finalized.
Testing & Quality Standards
All products undergo mandatory third-party laboratory testing prior to transfer per 7.35.2.19 NMAC. Required analyses include potency quantification (psilocybin and psilocin content), microbial contamination screening, heavy metals analysis, and pesticide residue testing. Certificates of Analysis are maintained for every batch.
Transfer Documentation Standards
Every transfer from Sacred Alto Spores to a permitted recipient entity is governed by a documented chain-of-custody protocol compliant with 7.35.2.24 NMAC.
Permit Verification
Prior to finalizing any order, Sacred Alto Spores verifies the current permit status of the recipient entity with the New Mexico Department of Health. The receiving party's NMDOH practitioner or producer permit number is confirmed before any product is transferred. Expired, suspended, or unverifiable permits disqualify a recipient from any transfer.
Transfer Manifest Preparation
A state-compliant chain-of-custody form is prepared for each transfer, documenting: date and time of departure, transporter name, product description, unique identification numbers, NTEP-certified net weight, destination and receiving party, and required signatures from both transporter and recipient.
Labeling & Packaging Verification
Before departure, the permitted producer verifies that all outbound product is sealed in tamper-evident packaging and labeled in full compliance with state requirements — including strain identity, batch unique ID, NTEP-certified net weight, COA reference, and producer permit number. Labels are printed and applied by the permitted producer.
Secure Transport by Permitted Producer
All transfers are conducted by the owner/permittee as the sole authorized transporter per 7.35.2.24 NMAC. Products are secured in a locked hard-sided container inside the transport vehicle. Products are never left unattended during transit, and the permitted producer personally delivers every order.
Recipient Identity Verification & Acknowledgment
Upon delivery, the receiving party's identity is verified using a government-issued photo ID. The receiving party provides their printed name, title, signature, and verified ID type on the chain-of-custody form. Delivery is not completed unless identity is verified and documented.
Traceability System Reporting
All transfers are logged in the state traceability system per 7.35.2.15 NMAC before departure and confirmed after delivery — including product unique identification numbers, NTEP-certified weights, destination, date and time of transport, and delivery confirmation. Sacred Alto Spores maintains complete transfer records available for regulatory inspection at any time.
Chain-of-Custody Standards
From initial inoculation through permitted transfer, every batch carries a complete, auditable chain of custody — executed entirely by the permitted producer and logged in the state traceability system per 7.35.2.15 NMAC.
Cultivation Records
Strain identity, inoculation date, substrate composition (coco coir, vermiculite, gypsum, grain), environmental conditions, and growth cycle documentation for every cultivation batch — prepared and logged by the permitted producer.
Harvest & Homogenization Records
Harvest lot unique ID, harvest date, drying method and duration, homogenization date, homogenized lot unique ID, and yield weight — all logged in the traceability system per 7.35.2.13 NMAC. Homogenization is performed by the permitted producer using a validated multi-step grinding protocol to ensure uniform psilocybin distribution across the batch.
NTEP-Certified Weight Records
All finished product is weighed by the permitted producer on an NTEP-certified scale in compliance with New Mexico Department of Agriculture standards. Certified weight documentation is generated for every batch and serves as the verified quantity basis for all transfer manifests and traceability entries.
Laboratory Testing Records
Third-party Certificate of Analysis for every batch: potency (psilocybin and psilocin), microbial, heavy metals, and pesticide panels per 7.35.2.19 NMAC. No product is transferred without a passing COA on file. COA records are maintained by the permitted producer and available to permitted recipients upon request.
Labeling & Packaging Records
Labels are printed and applied by the permitted producer before any product leaves the facility. Each label includes strain identity, batch unique ID, NTEP-certified net weight, COA reference, producer permit number, and all required regulatory disclosures. Packaging is tamper-evident and verified before every transfer.
Transfer & Delivery Records
Complete chain-of-custody forms, recipient permit verification records, transport logs, identity verification documentation, and signed delivery acknowledgments for every outbound transfer — personally executed by the permitted producer as sole authorized transporter.
Inventory Records
Real-time inventory tracking in the state traceability system. All product movements — including sales, transfers, waste destruction, and theft — logged with timestamps per 7.35.2.15 NMAC.
Waste & Disposal Records
All psilocybin waste destruction events logged in the traceability system per SOP section 11, including waste type, reason for destruction, method of rendering unusable, and date of disposal per 7.35.2 NMAC.
